Maduro’s capture on January 3, 2026 marked a turning point in Venezuelan politics, but for Venezuelans living in the U.S., immigration policies remain unchanged.
✔ TPS has not been reinstated – DHS Secretary Kristi Noem announced on September 10, 2025 that TPS for Venezuelans would end, and the program officially expired on September 10, 2025, affecting over 600,000 people.
✔ Deportation flights continue, On January 5, 2026, Noem confirmed on Fox News Sunday that deportations will proceed despite Maduro’s capture.
✔ Refugee and asylum options remain limited, On January 4, 2026, Noem suggested former TPS holders could apply for refugee status, but DHS clarified this only applies from outside the U.S.
✔ Community leaders are speaking out. In Miami, Commissioner Eileen Higgins urged the administration on January 3, 2026 to restore TPS for Venezuelans, calling its removal “irresponsible and dangerous.” Similarly, Chicago Mayor Brandon Johnson has joined the call, emphasizing the urgent need for humanitarian relief.
For thousands of Venezuelans, the future remains uncertain. Legal pathways are limited, and enforcement continues, making it essential to stay informed and prepared as policies evolve.
